AUSTRALIA: THE NEW TSS VISA (SUBCLASS 482) Launched on 18 March 2018, replaces the subclass 457

On Sunday 18 March 2018, The Department of Home Affairs has announced that the new TSS visa (Temporary Skills Shortages Visa) subclass 482 will replace the Subclass 457- Temporary Work visa.

The TSS visa enables employers to address labour shortages by bringing in genuinely skilled workers where they cannot source an appropriately skilled Australian. It facilitates targeted use of overseas workers to address temporary skill shortages, while ensuring that Australian workers get priority. TSS visa holders can work in Australia in their nominated occupation for their approved sponsor under one of these three streams:

• The Short Term Stream
• The Medium Term Stream
• The Labour Agreement Stream

-To apply under Short Term Stream,
• Occupation should be on the Short-term Skilled Occupations List (STSOL).
• Should have taken one of the Approved ENGLISH Tests.
• The initial visa will be granted for a period of 2 Years.
• Can be Renewed Only once for another 2 years
• Will NOT lead to Permanent Residency.

– To apply under the Medium-Term Stream, there are more conditions required to be fulfilled:
• Applicant’s occupation should be listed on the Medium and Long-term Strategic Skills List (MLTSSL);

‒ Additional occupations are available to support regional employers.
• Should have taken one of the Approved ENGLISH Tests.
• The initial visa will be granted for a period of 4 Years can be Renewed for another 4 years
or
• Can apply for Permanent Residency through the Company Sponsored Employer Route

General Requirement for both the Streams are:
• Requires at least two years’ work experience in the nominated occupation or a related field.
• Labour Market Testing (LMT) is mandatory, unless an international obligation applies.
• Employers must pay the Australian market salary rate and meet the Temporary Skilled Migration Income Threshold requirements.
• A discretionary non-discriminatory workforce test to ensure employers are not actively discriminating against Australian workers.
• The Skilling Australian Fund (SAF) Bill, is currently being debated in the Parliament. Once it is passed, Employers nominating a worker for a TSS visa will be required to pay a contribution:
 payable in full at the time the worker is nominated;
 $1200 per year or part year for small businesses (those with annual turnover of less than $10 million) and $1800 per year or part year for other businesses.
 businesses sponsoring TSS workers will be subject to the existing training expenditure

-The Labour Agreement stream may be utilised in exceptional cases where standard visa programs are not available and there is a demonstrated need that cannot be met in the Australian labour market.
